Welcome to the website of the New River Valley Preservation Coalition ("we," "us," "our," or “NRV Preservation Coalition”). We are a nonprofit organization dedicated to the conservation and stewardship of natural lands in the New River Valley region of Virginia.
This combined Privacy Policy and Terms of Use ("Agreement") governs your access to and use of our website located at [INSERT WEBSITE URL] (the "Site"). By accessing or using the Site, you agree to be bound by this Agreement. If you do not agree with these terms, please do not use the Site.

If we become aware that we have inadvertently received personal information from a child under 13, we will delete it promptly. 8. Virginia Privacy Rights
If you are a resident of the Commonwealth of Virginia, you may have certain rights under the Virginia Consumer Data Protection Act (VCDPA) with respect to your personal data, including the right to:
• Access personal data we have collected about you
• Correct inaccuracies in your personal data
• Request deletion of your personal data
• Opt out of the sale of personal data (note: we do not sell personal data)
Because we collect only limited contact form data and do not sell or process data for targeted advertising or profiling, many VCDPA provisions may not apply to our operations. Nevertheless, we are committed to honoring these rights. To submit a request, please contact us using the information at the end of this Agreement. We will respond within 45 days as required by applicable law. You may be required to verify your identity before we process your request.
Note: The VCDPA and related Virginia regulations are a developing area of law. You may wish to consult an attorney to verify your specific rights and our current obligations, as the law may have evolved since this document was last updated.
9. Third-Party Links
The Site may contain links to external websites operated by third parties. These links are provided for informational convenience only. We do not control those websites and are not responsible for their content or privacy practices. Visiting a third-party website from our Site is at your own risk.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date at the top of this Agreement. We encourage you to review this page periodically. Your continued use of the Site after any changes constitutes your acceptance of the updated Policy.
PART II — TERMS OF USE
11. Acceptance of Terms
By accessing or using the Site, you confirm that you are at least 18 years of age (or are a minor using the Site under the supervision of a parent or legal guardian), that you have read and understood this Agreement, and that you agree to be bound by its terms.
12. Permitted Use of the Site
You may access and use the Site for lawful, personal, and non-commercial purposes consistent with its educational and conservation mission. You agree not to:
• Use the Site in any way that violates applicable federal, state, or local law or regulation
• Transmit any unsolicited or unauthorized advertising or promotional material (spam)
• Attempt to gain unauthorized access to any part of the Site, our servers, or any system connected to the Site
• Interfere with or disrupt the integrity or performance of the Site
• Use automated tools (bots, scrapers, crawlers) to collect content from the Site without our express written permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or any other harmful code
13. Intellectual Property
All content on the Site, including but not limited to text, photographs, graphics, logos, and design elements, is the property of the NRV Preservation Coalition or its content contributors and is protected under applicable United States copyright and intellectual property law.
You may view, download, and print materials from the Site solely for your personal, non-commercial use, provided that you do not modify the materials and that you retain all copyright and proprietary notices. Any other use, reproduction, distribution, or modification of Site content requires our prior written permission.
The NRV Preservation Coalition name, logo, and related marks are trademarks of the organization. Nothing in this Agreement grants you any right to use our trademarks without our prior written consent.
14. User-Submitted Content
If you submit any content to us through the contact form or otherwise (such as photographs, comments, or written materials), you represent that you have the right to share such content and that it does not violate any law or the rights of any third party.
By submitting content to us, you grant the NRV Preservation Coalition a non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content in connection with our conservation mission and communications, unless you expressly request otherwise at the time of submission.
15. Disclaimer of Warranties
THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representations regarding the accuracy, completeness, or timeliness of any information on the Site.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY VIRGINIA LAW, THE NRV PRESERVATION COALITION, ITS OFFICERS, DIRECTORS, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.
Our total liability to you for any claim arising from your use of the Site shall not exceed one hundred dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; if such laws apply to you, some or all of the above limitations may not apply.
17. Indemnification
You agree to indemnify, defend, and hold harmless the NRV Preservation Coalition and its officers, directors, volunteers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of this Agreement, or your violation of any law or the rights of any third party.
18. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in the New River Valley region of Virginia, and you consent to personal jurisdiction in such courts.
We encourage you to contact us directly to resolve any concerns before initiating formal legal proceedings.
19. Severability
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
20. Entire Agreement
This Agreement constitutes the entire agreement between you and the NRV Preservation Coalition with respect to your use of the Site and supersedes all prior or contemporaneous communications, whether electronic, oral, or written, between you and us regarding the Site.
21. Waiver
Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of the NRV Preservation Coalition to be effective.
